ANCWL welcomes the ruling of constitutional court on the unconstitutionality of section 7 (1) of recognition of customary marriages act Of 1998

1 December 2017

The African National Congress (ANCWL) welcomes the ruling by Constitutional Court (ConCourt) on the 30 November 2017.

The ConCourt confirmed an order by the Limpopo High Court which declared Section 7 (1) of the Recognition of Customary Marriages Act of 1998 invalid. The ConCourt ruling advances the importance of non-discrimination and protects the property rights of women in customary marriages.

The ANCWL is against laws that perpetuates any form of inequalities and applauds the Courts for declaring of section 7 (1) of the Recognition of Customary Marriages Act of 1998 invalid. This section of the Act discriminated unfairly against women in customary marriages and has to be scrapped.

Radical economic transformation now or never!!
