ANCWL statement on appointment of commission of inquiry on State Capture by State President

ANCWL statement on appointment of commission of inquiry on State Capture by State President

10 January 2018

The African National Congress Women's League (ANCWL) welcomes a decision by the State President Jacob Zuma to appoint a Commission of Inquiry on State Capture.

ANCWL supports the fight against corruption in government and private sector without fear or favour and firmly believes that the Commission of Inquiry will expose all those involved in fraud and corruption by capturing parts of State and rendering the State vulnerable and incapable of wholly serving the people but serves only certain individuals.

Now that the Commission of Inquiry into State Capture is about to resume, the ANCWL is hoping that all with evidence will make submissions to the Commission. Section 35(3)(h) of the Bill of Rights guarantees for everyone the right to a fair trial, which includes the right to be presumed innocent at that trial until proven guilty. The ANCWL is confident that the Commission of Inquiry will not be influenced by any prior judgements passed through courts of public opinions which were instituted by neoliberal media houses.

The ANCWL has been consistent in calling for full scale investigation on the allegations of State Capture instead of a narrow politically motivated investigation. It is our hope that terms of reference of the Commission of Inquiry to be appointed by His Excellency President Zuma will include all the State owned entities (SoE's) without exception and will date back to pre-1994.

The ANCWL also support the decision by State President Zuma to appeal the order by Court that he is personally liable for the legal costs for challenging certain parts of the public protector report regarding the duties of the President to appoint commissions of inquiry in terms of section 84 of the Constitution. The order set a precedent for the Office of State President and the Higher Courts must provide legal clarity.

ANCWL calls all its members and supporters to be at the forefront of the fight against fraud and corruption in government and private sector.

All those who will be found guilty by the Commission of Inquiry on State Capture must face the full wrath of the law.
